HOW TO PITCH WORKSHOP TERMS

 

PURPOSE

The purpose of these Workshop Terms (the “Workshop Terms”) is to explain the terms and conditions you agree to by purchasing access to the HOW TO PITCH recorded workshop hosted by THE WILD VOICE, INC. (the “Company”) and facilitated by Samara Hayes, commonly known as Samara Bay (“SB”).

 

PRIVACY POLICY & TERMS OF USE

The Privacy Policy and the Website Terms of Use located at www.samarabay.com (the “Website”) apply to these Workshop Terms and are incorporated herein by reference.

 

SCOPE OF SERVICES

The HOW TO PITCH workshop is a nearly 90 minute recorded Zoom workshop facilitated in a group setting (the “Program”). By purchasing the Program through the Website, you will be receiving the following services:

  • 1 recorded workshop;
  • 1 sample written pitch document based on SB's original one-sheet for iHeartRadio;
  • Ongoing drop-in office hours with SB to be held monthly or quarterly over Zoom. Terms subject to change;

 

You will not be receiving any formal private coaching or other products or services offered by the Company other than what is stated above. If you wish to purchase other products or engage in other Services offered by the Company or SB you must enter into a separate agreement.

 

PAYMENT & REFUNDS

You understand that payment is required to receive the Services.

Payment in Full. You are responsible for a one-time payment of $197.00

Failure to Pay. If you fail to make any payment for any reason, you will not be entitled to participate in the Program and the Company reserves the right to suspend your participation until payment is made or to terminate your participation in the Program entirely after providing you with 7 calendar days’ notice in writing.

 

Refund Requests. There are no refunds. Please purchase with love and care.

 

YOUR DUTIES

The HOW TO PITCH workshop is a coaching program that requires you to participate in order to see your desired results. Your duties as a participant of the Program include: making the best effort including, but not limited to, consuming the content, participating in the Zoom office hours if you desire coaching, abiding by the HOW TO PITCH workshop rules including changes to the rules from time to time, and cooperating with requests for feedback and testimonials. The Company reserves the right to terminate your membership or participation in the Program for violating any applicable rules or creating an environment that does not align with the values of SB and the Company: “This is for you if you're committed to anti-racism, gender justice, and dismantling oppressive structures where you are.”



OUR COMMUNICATIONS

As a participant of the Program, you agree to use email as the primary method of communication with the Company. Communications via social media platform are appropriate, but for any important communication for which you request a response, email [email protected]. The Company will not accept phone calls, text messages, Voxer, or other methods of communication. You should expect to receive a response to your email or communication within 48 hours, not including weekends and business closures. In the event the Company or SB are unavailable, you will be notified in advance in writing.

 

GROUP COACHING

You understand that the Zoom office hours services will be rendered in a group setting with other individuals. The Company is not responsible for the thoughts, expressions, content or actions from other individuals in any group setting including, but not limited to, on live calls and in person. You also understand that participants may share personal or sensitive information with other individuals and, although the Company has made efforts to make the environment safe, secure, and inclusive, the Company cannot guarantee the information shared by you in group settings will be kept confidential by other individuals. You therefore understand you are sharing information with this risk in mind and should consider information shared in group settings to be public information.

 

NO PROFESSIONAL RELATIONSHIP

You understand that these Workshop Terms are an agreement to facilitate a coaching relationship to provide you with supplemental support for your speaking and speech journey. There is no relationship invoking any type of legal, medical, or licensed nature between you and the Company, you and SB or any guests or representatives of the Company. Nor is there any relationship invoking duties and expectations of agency such as you being an employee or affiliate of the Company. If you are interested in engaging in a commercial relationship outside of these Workshop Terms with the Company or SB, you must enter into a separate agreement.

 

CONFIDENTIALITY

Although we strive to provide a safe environment for all participants, we cannot guarantee the confidentiality of the information you share on group coaching calls or in person. You should treat any information shared in the group setting as public information. Information shared in 1:1 settings between you and SB will be kept confidential, unless you consent otherwise.

 

NO GUARANTEES

Nothing in these Online Terms and nothing in the Company’s statements to you shall be construed as a promise or guarantee about the outcome or development of your business or speaking aspirations.



INTELLECTUAL PROPERTY

The content provided in the Program including but not limited to live and recorded content, worksheets, video, audio, logos, workshop name, coined phrases, graphics, and processes are the intellectual property of the Company and subject to protection by copyright and trademark law. Your purchase of the HOW TO PITCH workshop does not give you a license to use the content in the Program for your commercial use or other use outside of the Program without the express written permission of the Company. You agree not to duplicate or share the content of the Program with third parties who are not participants of the Program. The Company reserves the right to revoke your access to content and materials, and terminate your participation, if necessary, if the Company has reason to believe you have violated these Workshop Terms or the company’s intellectual property rights.

 

PERSONAL ACCESS ONLY

Access to the Program is for one person only. You agree not to share your workshop materials or group content with any other person or entity who has not purchased the Program.

 

FORCE MAJEURE

In the event that the Company is unable to perform under these Workshop Terms due to circumstances outside of the Company’s control including, but not limited to sudden extreme illness, an act of God, act of terrorism, flood, war, government laws and/or regulations, and technical difficulties, the Company shall not be held liable for any failure or delay of performance of their obligations under these Workshop Terms. In the event of a Force Majeure occurrence, the Company will exercise its best efforts to facilitate the Program including issuing a refund if the Company deems it necessary.

 

INDEMNIFICATION

You agree to defend, indemnify and hold harmless the Company and its agents from and against all third party claims, liabilities, losses, damages, costs, expenses, judgments and/or penalties arising out of or related to your participation in the Program.

 

TERM & TERMINATION

The Program shall commence on the date of purchase and be available ongoing, unless the terms change. If terms change (for example: SB is unable to offer office hours over Zoom, or the HOW TO PITCH workshop is removed) you will be notified in advance via email. 

 

MISCELLANEOUS

Over the Age of 18: By purchasing the Program, you certify you are over the age of 18 or have your parent or guardian’s permission to agree to these Workshop Terms.

Amendments: These Workshop Terms may be modified by the Company.

Assignment. You do not have the right to assign or transfer these Workshop Terms to another person or entity without the written consent of the Company. 

Governing Law: These Workshop Terms are governed by the laws of the State of California and any applicable federal law.

Severability: If any provision of these Workshop Terms is held to be unenforceable for any reason, the remainder of that provision will be severable and remain in full force and effect.

Headings. The use of headings in these Workshop Terms are for organizational purposes only and have no legal effect.

Technology. The Company reserves the right to change the technology or method of delivery for the Program as necessary.

Dispute Resolution: Any disputes will be governed in accordance with the Website Terms of Use.

Entire Agreement: These Workshop Terms constitute the entire agreement between you and the Company with respect to the HOW TO PITCH workshop. No other agreement, statement, or promise will be binding.
